Contract for Purchase of a Sparkles & Spurs Dachshund

 

When you purchase a puppy from Sparkles & Spurs you are agreeing to this contract, whether you sign it or not.

 

Contract between the seller, Sparkles & Spurs Dachshunds, and the Buyer, _______________________________________________.

To the best of the knowledge of Sparkles & Spurs the above named puppy is in healthy and sound condition at the time of sale. Buyer has 72 hours from the time of delivery/pickup to have a vet check done on the puppy. Vet check must be done by licensed veterinarian. Buyer must retain vet documents showing dates and procedures of the vet check for future reference. Buyer is required to administer, or have administered by a veterinarian, routine puppy vaccinations on a veterinarian recommended schedule, with the last vaccination given at an age no younger than 16 weeks. Given vaccines must aid in the prevention of parvovirus and distemper. First vaccines were given by seller at 6 weeks of age. If the buyer fails to have a veterinarian check done within above named time or fails to continue vaccines as stated above, this contract will be considered null and void for the said puppy. No exceptions.

No other guarantees, verbal or implied will be considered. All deposits are non-refundable and non-transferable, except in the event that above named puppy becomes ill or injured while still in the care of Sparkles & Spurs. In aforementioned case the buyer will have the option to receive either a refund of their deposit, or transfer existing deposit onto another puppy if one is available. This contract is valid only for the original buyer of the said puppy. If said puppy is sold, given away, or encounters any other transfer of ownership, this contract is to be null and void.

All puppies are sold as companions only.  However, this does not mean that the puppy may not be of show quality.

Buyer agrees to proper care and management of their dachshund puppy for the entirety of it's natural life. This includes proper nutrition, access to clean water and proper shelter from the elements. As well as both routine and preventative veterinary care as needed. Buyer also agrees to age appropriate activity and to take care in proper management as well (i.e. steps for any furniture, vehicle, etc that the puppy is allowed to access. As Dachshunds are prone to spinal injuries when jumping or over exerting.) Buyer agrees to have any injuries assessed and treated as soon as possible by a licensed veterinarian.

Above named puppy is guaranteed against inherited congenial defects of the patellas, hips and eyes, only for the period stated below: no other guarantees will be made. Seller will not cover any injury to said puppy due to cruelty or accident of any kind.

Hip dysplasia is warrantied per this contract for a period of 24 months.

Patellar luxation is warrantied per this contract for a period of 24 months.

Inherited defects of the eyes will also be covered for a period of 24 months.

Health guarantee does not cover the finding of any parasite, internal or external as this is a treatable condition.  Only untreatable and/or genetic diseases or defects will be considered under the seller's health guarantee.

Seller is in no way responsible for any vet bills made after puppy leaves the care of Sparkles & Spurs. In the event that a condition warrantied by this contract should arise the above named puppy shall be replaced with a puppy of equal value from the next available litter, provided that the said puppy was returned to the breeder in the same condition as it was sold. All shipping cost will be the responsibility of the buyer. Buyer must provide a letter from a licensed veterinarian that states the condition of the puppy. Seller reserves the right to have puppy seen by veterinarian of their choice, buyer may be present. Seller will not refund money in whole or in part for any reason.

 

Seller cannot guarantee the adult size of any puppy/dog. We do however try to come close based on the size of the sire and dam. This contract does not cover any guarantee on size, eye color or coat color of named puppy. Puppy is not returnable due to any eye color or coat color change that may take place after sale.

 

In the event the said puppy cannot be cared for by the owner, Sparkles & Spurs is to be notified so a suitable home can be found. No Sparkles & Spurs puppy or adult dog should be placed in any animal shelter, sold to any research or testing facility or surrendered to any rescue group. If at any time the owner finds themselves no longer able to care for a dog/puppy purchased from Sparkles & Spurs, the owner is to notify seller immediately. No exceptions.

 

This contract is under the jurisdiction of the state of Texas, in the county of Palo Pinto. It is agreed the place of venue shall be Palo Pinto County, Texas. All attorney fees shall be paid by the plaintiff. I, the undersigned buyer, have read, understand and agree with all of the terms and conditions set forth in this purchase contract.
